Acceptance of the Terms of Service

These terms of service are entered into by and between You (“Participant(s)”) and Living Your Truth with the Guides (“Company,” “Service Provider,” “we,” or “us“). The following terms and conditions govern your access to the provision of various metaphysical services provided by Living Your Truth with the Guides (“Services”).

Please read the Terms of Service carefully before you procure services or take courses provided by us. By using and paying for the services provided at livingyourtruthwiththeguides.com and at https://living-your-truth-with-the-guides.mykajabi.com or clicking to accept or agree to the Terms of Service when this option is made available to you, you accept and agree to be bound and abide by these Terms of Service, our Terms of Use, found at https://livingyourtruthwiththeguides.com/terms-of-use/ and our Privacy Policy, found at https://livingyourtruthwiththeguides.com/privacy-policy/, incorporated herein by reference.

Changes to the Terms of Service

Living Your Truth with the Guides may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

Description Services

Living Your Truth with the Guides provides metaphysical services and teaches courses for entertainment purposes only.  The relationship that arises between the participant and the Service Provider shall be a professional one that is designed to facilitate the participant’s personal development.

Participant – Service Provider Relationship

The participant is solely responsible for his or her physical, mental, and emotional well-being.  Participant acknowledges that the services provided is not a substitute for therapy, if needed, and does not prevent, cure or treat any mental disorder or medical disease.

Participant acknowledges that the service provided does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that it is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Participant’s exclusive responsibility to seek such independent professional guidance as needed.

Use of the Service by Minors

By using the Services, you affirm that you are of legal age to enter into this Agreement or, if you are not, that you have obtained parental or guardian consent to enter into this Agreement.

A parent or legal guardian of any participant under the age of 18 (“Minor”) may prohibit such individual’s use of the Services. If you are the parent or legal guardian of a Minor and believe that such individual has procured our Services without your consent or authorization, please contact us at maricar@livingyourtruthwiththeguides.com.

Notwithstanding the foregoing, Minors under sixteen (16) years of age are not permitted to access or use the Services or to enter into this Agreement, even if a parent or guardian would be willing to provide consent.

Confidentiality

The Service Provider agrees to maintain the confidentiality of information shared by participants during the provision of services.  However, please be aware that this relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege.

Confidential Information does not include information that: (a) was in the Service Provider’s possession prior to its being furnished by the Participant; (b) is generally known to the public; (c) is obtained by the Service Provider from a third party, without breach of any obligation to the Participant; (d) is independently developed by the Service Provider without use of or reference to the Participant’s confidential information; or (e) the Service Provider is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the Service Provider and as a result of such disclosure the Service Provider reasonably believes there to be an imminent or likely risk of danger or harm to the Participant or others; and (g) involves illegal activity. The Participant also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Service Provider in a timely manner.

Fees, Taxes, and Payment

Fees for the Services (“Fees”) are set forth in https://livingyourtruthwiththeguides.com/book-a-reading/ and https://living-your-truth-with-the-guides.mykajabi.com/store. 

All customs, value-added tax, levies, charges, and other taxes and duties other than income taxes owed by Service Provider (“Taxes”) arising in connection with the provision of services shall be paid by Participant in full without any withholding or deduction whether on account of any set-off, Taxes, or otherwise.

Participant authorizes Living Your Truth with the Guides to accept payment as directed by you and authorize Living Your Truth with the Guides to charge your credit card on file, if any, for any and all amounts due pursuant to this Agreement.

Cancellation, Rescheduling, and Refund Policy for Services

Refund Policy for Readings

In the event that the Participant has decided to cancel scheduled calls or meetings with the Service Provider, Participant agrees that it is the Participant’s responsibility to provide written notification to the Service Provider at least 24 hours in advance of the scheduled call or meeting. After 24 hours of a scheduled call or meeting, no cancellations will be granted and no refunds will be issued.

A participant may reschedule a scheduled call or meeting by providing a written request to the Service Provider at least 24 hours in advance of the scheduled call or meeting. After 24 hours of a scheduled call or meeting, no sessions can be rescheduled.

The Service Provider reserves the right to bill the participant for a missed meeting.

Refund Policy for Courses

Due to the nature of courses as digital products, the Service Provider does not grant refunds for courses.

Suspension

Service Provider may at any time suspend the provision of Services to Participant if (1) Participant materially breaches this Agreement; (2) Participant impedes Service Provider’s provision of the Services; or (3) Service Provider is Legally Compelled. Service Provider shall not be liable to Participant for suspension of the Services in accordance with this provision.

Limited Liability

Living Your Truth with the Guides provides entertainment services only.  We do not warrant the accuracy, completeness, or usefulness of any information that arises from any provision of services.  Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you.

Except as expressly provided in this Agreement, the Service Provider makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the provision of services negotiated, agreed upon and rendered. In no event shall the Service Provider be liable to the Participant for any indirect, consequential or special damages. Notwithstanding any damages that the Participant may incur, the Service Provider’s entire liability under this Agreement, and the Participant’s exclusive remedy, shall be limited to the amount actually paid by the Participant to the Service Provider under this Agreement for all services rendered through and including the termination date.

Entire Agreement

This document reflects the entire agreement between the Service Provider and the Participant, and reflects a complete understanding of the parties with respect to the subject matter. This Agreement supersedes all prior written and oral representations. The Agreement may not be amended, altered or supplemented except in writing signed by both the Service Provider and the Participant.

Indemnification

Participant agrees to indemnify and hold harmless Living Your Truth with the Guides from any and all claims, demands, suits, expenses, costs, judgments or other charges incurred by the Participant as a result of your choice to procure the services as outlined by this Agreement. Participant will not hold Living Your Truth with the Guides or its Service Providers or other employees responsible for any negligent actions or adverse results, whether known or unknown, that the Participant may incur or suffer as a result of the provision of services pursuant to this Agreement.

Dispute Resolution

If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Participant and the Service Provider agree to attempt to mediate in good faith for up to one year after notice is given. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party.

Severability

If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

Waiver

The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel compliance with every provision of this Agreement.

Applicable Law

This Agreement shall be governed and construed in accordance with the laws of the State of Hawaii, without giving effect to any conflicts of laws provisions.
